Terms and Conditions for Colorado Oxygen Services LLC.
These Terms and Conditions ("Agreement") govern the use of the oxygen repair and sales services provided by Colorado Oxygen Services LLC. By engaging in any transaction or using our services, you agree to be bound by these terms. Please read this Agreement carefully before proceeding with any transactions or using our services.
1. Services Provided
1.1. Oxygen Equipment Repair: We offer repair services for oxygen equipment, including but not limited to concentrators, homefill compressors, and general oxygen equipment. Our repair services aim to restore the functionality and safety of the equipment.
1.2. Oxygen Equipment Sales: We provide oxygen equipment for sale, including new and refurbished/repaired concentrators, cylinders, and accessories. All sales are subject to availability.
2. Customer Responsibilities
2.1. Accurate Information: You are responsible for providing accurate and complete information about your oxygen equipment, including model, make, and any relevant details, to ensure appropriate repair or sales recommendations.
2.2. Equipment Ownership: You represent that you are the legal owner or authorized user of the oxygen equipment being repaired or purchased. You agree to provide proof of ownership or authorization if requested by the Company.
3. Repairs and Sales Process
3.1. Assessment and Estimates: For repair services, we will assess the condition of the oxygen equipment and provide an no cost estimate of repair costs, if applicable. Estimates are based on initial assessment and may change if additional issues are identified during the repair process.
3.2. Approval and Payment: Upon receiving the repair estimate or sales quotation, you must provide explicit approval and make the necessary payment, as per the agreed-upon terms. Repair work or sales processing will commence only after receipt of payment.
3.3. Turnaround Time: We strive to complete repairs or sales processing within a reasonable timeframe. However, specific turnaround times are estimates and subject to unforeseen circumstances or delays. We will communicate any significant delays promptly.
4. Fees and Payments
4.1. Repair Costs: Repair costs will be communicated to you before the commencement of repair work. Costs may include parts, labor, taxes, and shipping charges, if applicable. Repair costs are subject to change if additional issues are discovered during the repair process.
4.2. Sales Prices: Sales prices for oxygen equipment will be provided in the quotation. Prices may be subject to taxes and shipping charges, if applicable.
4.3. Payment Methods: We accept payment via authorized credit/debit cards, electronic funds transfers, or other agreed-upon payment methods. Payment details will be provided upon request or included in the invoice.
4.4. Non-payment: Failure to make timely payments may result in delays in repair work or order processing. We reserve the right to withhold repaired equipment or cancel sales orders until payment is received in full.
5. Warranty and Liability
5.1. Repair Warranty: We provide a 3 month warranty for repaired equipment, covering the repaired components and labor, as specified in the warranty terms provided upon completion of repairs.
5.2. Sales Warranty: New equipment sales may include a manufacturer's warranty. Refurbished equipment sales may include a limited 3 month warranty provided by the Company. Specific warranty terms will be provided in writing at the time of purchase.
5.3. Limitation of Liability: Our liability is limited to the repair or replacement of equipment or refunding the purchase price, at our discretion, for valid warranty claims. We are not liable for any direct or indirect damages, including but not limited to lost profits, arising from the use or misuse of oxygen equipment.
5.4. Indemnification: You agree to indemnify and hold us harmless from any claims, damages, or liabilities arising from the use of repaired or purchased oxygen equipment.
5.5. Warranty excludes physical damage, water damage, infestations, preventive maintenance, and filters. TOBACCO RELATED SMOKE SUCH AS CIGARETTES AND INFESTATIONS VOID WARRANTY.
6. Privacy and Data Protection
6.1. Data Collection: We may collect and store personal information necessary for providing our services. By using our services, you consent to the collection, use, and storage of your personal information in accordance with our Privacy Policy.
6.2. Confidentiality: We will treat all information provided by you as confidential and will not disclose it to third parties unless required by law or with your explicit consent.
7. Termination
7.1. Either party may terminate this Agreement at any time for any reason by providing written notice to the other party.
7.2. Termination does not affect any rights or obligations that have accrued before the termination date.
8. Amendments
8.1. We reserve the right to modify or amend these Terms and Conditions at any time. Any changes will be effective immediately upon posting the revised Agreement on our website or providing notice to you.
8.2. It is your responsibility to review these terms periodically. By continuing to use our services, you accept any modifications to the Agreement.
9. Governing Law and Jurisdiction
9.1. This Agreement shall be governed by and construed in accordance with the laws of Colorado. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Colorado.
10. Abandoned Equipment
10.1. Any equipment left at Colorado Oxygen Services LLC for over 30 days with no written communication for pick up or service will be considered property of Colorado Oxygen Services LLC.
