Terms and Conditions

These Terms and Conditions (“Agreement”) govern all repair services, equipment sales, rentals, and related services provided by Colorado Oxygen Services LLC (“Company”). By purchasing equipment, requesting repair services, or otherwise conducting business with the Company, you acknowledge that you have read, understood, and agree to these Terms and Conditions.

1. Services Provided

1.1 Oxygen Equipment Repair

Colorado Oxygen Services LLC provides repair, maintenance, inspection, and preventive maintenance services for oxygen concentrators, portable oxygen concentrators, HomeFill compressors, oxygen cylinders, and related oxygen equipment.

1.2 Equipment Sales

We sell new and used oxygen concentrators, portable oxygen concentrators, oxygen cylinders, HomeFill equipment, accessories, replacement parts, and related medical oxygen equipment, subject to availability.

2. Customer Responsibilities

2.1 Accurate Information

Customers are responsible for providing accurate information regarding their equipment, including manufacturer, model, serial number, and a description of any known problems.

2.2 Ownership

The customer certifies they are the legal owner or authorized user of any equipment submitted for repair or offered for sale.

2.3 Prescription Requirements

The customer is responsible for obtaining any prescription required by federal or state law before purchasing or using oxygen equipment.

3. Repairs and Sales

3.1 Estimates

Colorado Oxygen Services provides free repair estimates whenever reasonably possible. Estimates are based upon the initial inspection and may change if additional problems are discovered during disassembly or repair.

3.2 Authorization

No repairs will be performed until customer approval has been received.

3.3 Payment

Payment is due upon completion of repairs or at the time of equipment purchase unless other arrangements have been made in writing.

3.4 Turnaround Time

Estimated completion dates are provided as a courtesy and are not guaranteed. Delays due to parts availability, shipping, manufacturer delays, or circumstances beyond our control may occur.

4. Pricing and Payments

4.1 Repair Charges

Repair charges may include labor, replacement parts, applicable taxes, shipping, and other authorized charges.

4.2 Equipment Pricing

Equipment pricing is subject to change without notice until payment has been received.

4.3 Accepted Payments

We accept approved credit cards, debit cards, cash, electronic payments, certified funds, and other payment methods approved by the Company.

4.4 Non-Payment

Colorado Oxygen Services reserves the right to withhold repaired equipment or cancel sales orders until payment has been received in full.

5. Limited Warranty

5.1 Used Stationary Oxygen Concentrators

Used stationary oxygen concentrators sold by Colorado Oxygen Services include a One (1) Year Limited Warranty covering defects in parts and workmanship under normal residential use.

5.2 Repair Warranty

Repairs performed by Colorado Oxygen Services include a Three (3) Month Limited Warranty covering replacement parts installed by Colorado Oxygen Services and the labor associated with those repairs.

5.3 Sieve Bed Warranty

Replacement sieve beds installed by Colorado Oxygen Services include a One (1) Year Limited Warranty against leaking or dumping under normal operating conditions.

5.4 Manufacturer Warranty

New equipment and portable oxygen concentrators are covered by the manufacturer’s warranty when applicable.

6. Return Policy

Portable Oxygen Concentrators

Portable oxygen concentrators are covered by the manufacturer’s warranty. Because the manufacturer’s warranty is activated upon purchase and due to the medical nature of this equipment, all portable oxygen concentrator sales are final after delivery, except where otherwise required by law.

If a portable oxygen concentrator is found to be defective, warranty service will be provided in accordance with the manufacturer’s warranty.

Used Stationary Oxygen Concentrators

Used stationary oxygen concentrators are covered by the Colorado Oxygen Services One (1) Year Limited Warranty. Equipment operating as intended is not eligible for return or refund because of customer preference, dissatisfaction, or change of mind.

Repair Services

Repair charges are non-refundable. If a covered repair fails during the warranty period, Colorado Oxygen Services will repair the covered issue in accordance with this warranty.

7. Warranty Exclusions

The Limited Warranty does not cover:

• Abuse or misuse
• Accidental damage
• Physical damage
• Water damage
• Fire or flood damage
• Power surges
• Neglect
• Failure to maintain filters or routine maintenance
• Normal cosmetic wear
• Damage caused by pets or insects
• Rodent or insect infestations
• Unauthorized repairs or modifications
• Tobacco smoke, cigarette smoke, cigar smoke, vaping residue, or other smoke contamination
• Consumable items including filters unless specifically covered

Preventive maintenance services are not covered under warranty.

Evidence of tobacco-related smoke contamination or infestation may void warranty coverage.

8. Limitation of Liability

Colorado Oxygen Services LLC shall not be liable for any indirect, incidental, consequential, or special damages arising from the use or inability to use equipment or services provided, to the maximum extent permitted by Colorado law.

The Company’s maximum liability shall not exceed the amount paid for the applicable repair or equipment.

9. Privacy

Customer information is collected only as necessary to provide requested services, process payments, maintain service records, comply with applicable laws, and communicate regarding repairs or purchases.

Colorado Oxygen Services does not sell customer information.

10. Abandoned Equipment

Equipment left with Colorado Oxygen Services without payment, pickup, or written communication for more than 60 days after notification that the equipment is ready may be considered abandoned. Colorado Oxygen Services reserves all rights available under applicable Colorado law regarding abandoned property.

11. Governing Law

This Agreement shall be governed by the laws of the State of Colorado. Any legal action arising from this Agreement shall be brought in a court of competent jurisdiction located within the State of Colorado.

12. Agreement

By purchasing equipment, authorizing repair, the customer acknowledges that they have read, understand, and agree to these Terms and Conditions.
